Global Director, Trade Compliance

This highly visible and rewarding position is the leader of the Global Trade Compliance team. This individual will manage critical components of international trade, aligning Global Trade Compliance with the Company's business strategies. The Global Director, Trade Compliance is responsible to ensure that Momentive Technologies is in compliance with the import and export laws of the countries where we do business. Compliance with trade regulations will be achieved through a centralized framework including classification, certification, and verification of import/export activities.

Responsibilities

Oversee and drive international trade compliance strategy and manage the Global Trade Compliance team

Demonstrate critical judgement in prioritizing Global Trade Compliance regional activities to ensure global alignment

Provide guidance to internal operations regarding export and import compliance requirements

Establish workflow/process improvements to optimize related global trade management activities

Identify the impact of proposed regulatory changes regulations, as well as trade-related initiatives

Point of contact for export and import related inquiries from internal and external stakeholders to ensure compliance with all applicable trade controls and requirements

Work with Customs Brokers to expedite clearance of goods; provide documented feedback to brokers on operational/compliance-related matters; and conduct post-entry/post-shipment audit of import/export shipments

Support external and internal (e.g. Customs and Border Patrol, Bureau of Industry and Security, Momentive Technologies) compliance audits and assessments and implementing any required/necessary corrective actions

Develop and deliver a training schedule and program that includes, but is not limited to, business partner due diligence screening, export controls, technology control plans, risk identification, and escalation. Conduct annual awareness and ad hoc tailored trainings, as required, to include new employees, engineering, logistics, sales, procurement, HR, and other key internal stakeholders at all global locations

Work closely with the business to conduct and document export control classification of items (i.e., material, parts, technology, software, equipment)

Assigning and verifying HS codes, developing and maintaining a certified database, applying for and controlling the existing binding classification rulings

Performing customer due diligence and managing various kinds of export compliance issues, such as export license determinations; license applications and approvals; management (incl. administration and maintenance) of the companies' denied party screening software; ensuring proper end-user documentation is obtained, verified and stored

Draft and submit export license applications in DECCS and SNAP-R, and work with the business to manage export licenses, agreements, or other authorizations as may be required

Conduct periodic internal and external compliance assessments to ensure adherence to policies, procedures, and compliance of all activities and transactions with the appropriate import/export laws and recordkeeping; coordinate with the Global Director, Compliance & Regulatory Affairs on issues, opportunities, recommended solutions and cost savings

Develop and manage a duty drawback program that identifies both current and future opportunities to reclaim duty paid on imported articles

Manage Free Trade Agreement qualification programs, including compliance and audits. Understand how to qualify items according to country-specific origin criteria and tariff codes for issuing certificates of origin to Customers

Quantify cost savings opportunities for participation in preferential trade programs; provide oversight of implementation of programs

Identify and escalate trade compliance gaps and potential reportable incidents to the Global Director, Compliance & Regulatory Affairs, mitigating compliance risks for company-wide visibility

Develop and implement an Incoterms policy in line with the company's preferred Incoterms

Partner with Logistics Leader in global supplier selection (marine, customs brokerage and freight forwarders), contract negotiation and implementation through strategic sourcing process

Establish broker KPIs, reporting, auditing and cadence

Driving continuous improvement, best practices, and standardization through the understanding of global trade regulations

Ensure reporting of key trade compliance matters to the Global Director, Compliance & Regulatory Affairs, as appropriate

Other activities as may be assigned by the Sr. VP, General Counsel in support of Trade Compliance activities

Basic Qualifications:

Bachelor's degree in Business, Logistics, Supply Chain or relevant field.

10+ years' experience in international trade compliance or logistics.

Minimum 8 years' experience with CBP regulations.

SAP system experience a must.

Experience in managing global cross-functional teams and projects in a fast-paced environment.

Proven trade record in designing and implementing compliance programs and managing complex trade compliance issues.

Prior experience working with high traffic volume, serving multiple international regions.

Experience in management position.

Certified Classification Specialist (CCLS).

Operational knowledge of export laws and regulations, particularly US International Traffic in Arms Regulations (ITAR), US Export Administration Regulations (EAR), EU Member States, and the Japan Ministry of Economy, Trade and Industry (METI).

Operational Knowledge of the WTO tariff valuation rules and basic experience with assigning and maintaining tariff codes.

Excellent interpersonal and influencing skills with the ability to communicate and interact at all levels and support decision-making based on credible knowledge of International Trade.

Ability to easily understand complex technical products. This could have been gained from previous experience in a similar manufacturing company.

Excellent problem solving and analytical skills.

Strong communication and interpersonal skills with the ability to collaborate effectively with diverse teams.

Practices transparency of information and data driven findings; high integrity.

Preferred Qualifications:

An MBA or an MS is an advantage.

Experience working in manufacturing.

Experience with SAP GTS module.

Continuous improvement mindset.

Change management, communicates effectively, builds commitment and overcomes obstacles.

Ability to develop and write clear and concise processes and procedures.

Experience managing programs, projects, and people - as this role could potentially have one direct report.

Experience in ITAR Categories and EAR ECCNs is a plus.

Experience managing and enforcing a Denied Party Screening program.

Successful candidate who thrives working in a small team with limited supervision, hands-on designing and building compliance modules to implement globally.

Solid computer skills: Proficient in MS Office Suite and experience with evidenced continued and ongoing development of trade compliance training, courses, seminars.

Key Relationships:

Reports to Sr Vice President, General Counsel

Proactively work with various internal partners such as the logistics, commercial teams, procurement, supply chain, operations, finance, IT, Engineering, and various logistics services providers to minimize risk and ensure efficient and effective processes for import/export transactions.

Travel Requirements:

5-10% of travel (domestic and international)

1st Shift office environment
